Welcome to HomeMark (“HomeMark,” “we,” “us,” or “our”). These Terms & Conditions (“Terms”) govern your access to and use of the HomeMark website, platform, applications, products, and services (collectively, the “Services”).
By accessing or using the Services, you agree to be legally bound by these Terms. If you do not agree with these Terms, you must not access or use the Services.

2. About HomeMark

3. User Accounts

You agree to:

- maintain the confidentiality of your login credentials;
- keep your account information updated;
- notify us promptly of unauthorized access or suspected security breaches; and
- accept responsibility for activities conducted through your account.
You must not create an account using another person’s identity or provide false, misleading, or fraudulent information.
We reserve the right to suspend or terminate accounts that violate these Terms or applicable law.

Users who submit property listings are responsible for ensuring that all information they provide is accurate, current, and lawful.

- ownership or agency information; and

You represent and warrant that you have the necessary rights and authority to publish any listing and its associated content.
You must not publish information that is false, misleading, fraudulent, defamatory, discriminatory, unlawful, or intended to deceive other users.
HomeMark may, but is not obligated to, review, edit, reject, remove, or restrict any listing or content.
5. Property Information and Accuracy
Property information displayed through the Services may be provided by users, agents, owners, developers, advertisers, or other third parties.
Although we may take reasonable steps to maintain the quality of the Services, HomeMark does not guarantee that property information is accurate, complete, current, available, or suitable for any particular purpose.
Users should independently verify important information, including ownership, title, zoning, permits, measurements, pricing, availability, legal status, and other property-related information before entering into any transaction.
6. Transactions Between Users
Any transaction or agreement between users is solely between the parties involved.
HomeMark is not responsible for:
- negotiating transactions;
- verifying ownership or title;
- inspecting properties;
- verifying financial information;
- guaranteeing payment;
- arranging financing;
- preparing legal documents;
- ensuring completion of a transaction; or
- resolving disputes between users.
Users are responsible for conducting their own due diligence and obtaining professional legal, financial, property, or other advice where appropriate.
7. Fees and Payments
Certain HomeMark Services may be offered for a fee.
Where applicable, the relevant price, billing terms, subscription period, renewal terms, taxes, and payment conditions will be presented before payment.
Unless otherwise stated:
- fees are payable in advance;
- payments may be processed by third-party payment providers;
- users are responsible for applicable taxes and charges; and
- fees are non-refundable except where required by applicable law or expressly stated otherwise.
If subscription services are offered, subscriptions may automatically renew unless cancelled in accordance with the applicable cancellation terms.
8. Prohibited Activities
You must not use the Services to:
- violate any applicable law or regulation;
- provide false, misleading, or fraudulent information;
- impersonate another person or entity;
- publish fraudulent or unauthorized property listings;
- infringe intellectual property or other rights;
- harass, threaten, abuse, or discriminate against other users;

- attempt to gain unauthorized access to accounts or systems;
- use automated systems to scrape, crawl, copy, or extract data without our written permission;

- engage in any activity that could damage HomeMark, its users, or the integrity of the platform.
9. User Content
You may be permitted to submit content to HomeMark, including text, photographs, videos, documents, reviews, comments, property information, and other materials (“User Content”).
You retain ownership of your User Content.
However, by submitting User Content, you grant HomeMark a worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, distribute, modify, adapt, and use that content as reasonably necessary to operate, provide, promote, and improve the Services.
You represent that:
- you own or have the necessary rights to submit the User Content;
- the content does not infringe any third-party rights;
- the content is not unlawful or fraudulent; and
- publication of the content does not violate any agreement or legal obligation.
We may remove User Content that we reasonably believe violates these Terms or applicable law.
10. Intellectual Property
The Services and their contents, including the HomeMark name, logos, designs, software, graphics, text, interfaces, databases, and other materials, are owned by or licensed to HomeMark and are protected by applicable intellectual-property laws.
Except as expressly permitted by these Terms, you may not copy, reproduce, modify, distribute, sell, license, reverse engineer, or commercially exploit any part of the Services without our prior written permission.
Nothing in these Terms transfers ownership of HomeMark’s intellectual property to you.
11. Third-Party Services and Links
The Services may contain links to or integrations with third-party websites, applications, payment processors, advertising services, or other platforms.
HomeMark does not control and is not responsible for third-party services, their content, availability, security, privacy practices, or terms.
Your use of third-party services is subject to the terms and policies of those third parties.

By creating an account or using the Services, you may receive service-related communications, including account notifications, security alerts, transaction-related messages, and administrative communications.
Where legally permitted and subject to your preferences, you may also receive marketing communications.
You may opt out of marketing communications by following the unsubscribe instructions provided in those communications.

HomeMark does not warrant that:

- information provided through the Services will always be accurate or complete;
- listings will remain available;
- transactions will be completed successfully; or
- the Services will meet every user’s particular requirements.
HomeMark does not provide legal, financial, investment, tax, surveying, valuation, brokerage, or other professional advice unless expressly stated otherwise.
15. Limitation of Liability
To the maximum extent permitted by applicable law, HomeMark and its directors, officers, employees, affiliates, contractors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of the Services.
This includes, without limitation, loss of profits, revenue, business opportunities, data, goodwill, or anticipated savings.
To the maximum extent permitted by law, HomeMark’s total liability arising out of or relating to the Services will be limited to the amount you paid to HomeMark for the relevant Services during the [three/six/twelve] months preceding the event giving rise to the claim.
Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.
16. Indemnification
To the extent permitted by applicable law, you agree to indemnify and hold harmless HomeMark and its directors, officers, employees, affiliates, contractors, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:
- your breach of these Terms;
- your User Content;
- your violation of applicable law;
- your violation of another person’s rights; or
- your use or misuse of the Services.
17. Suspension and Termination
We may suspend or terminate your access to the Services if:
- you breach these Terms;
- we reasonably believe your account is being used fraudulently or unlawfully;
- your activity creates a security or legal risk; or
- we discontinue or materially change the Services.
You may stop using the Services at any time.
Termination does not affect provisions that by their nature should survive termination, including provisions relating to intellectual property, disclaimers, liability, indemnification, disputes, and governing law.

23. Entire Agreement
These Terms, together with any policies or agreements expressly incorporated by reference, constitute the entire agreement between you and HomeMark regarding your use of the Services and supersede prior agreements concerning the same subject matter.
24. No Waiver
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
